Richmond, Virginia–Friday morning, The Family Foundation announced it has filed a procedural lawsuit to contest the Board of Health’s amendments to the sham restrictions on abortion providers that bring them into compliance with medical evidence and Supreme Court precedent. This lawsuit is a calculated step to delay the repeal and keep women from accessing the health care they need when they need it.
“This lawsuit is a blatant attempt to prevent women from making decisions about their own bodies and accessing the health care they need. Sham restrictions are politically motivated and unconstitutional,” Anna Scholl, Executive Director of Progress Virginia, said. “We applaud the Board of Health for fixing the sham restrictions on abortion providers and working to ensure that women have access to safe abortion care when they need it.”
In October 2016, the Board of Health amended the politically motivated sham restrictions to bring Virginia law into compliance with the landmark 2016 United States Supreme Court decision, Whole Woman’s Health v. Hellerstedt.
